Consumer Health Data Privacy Policy

This Consumer Health Data Privacy Policy (“Policy”) supplements the Excel Medical Privacy Policy (the “Privacy Policy”) and applies only to personal information that is considered “consumer health data” as defined in and subject to the Washington State My Health My Data Act and Nevada’s Consumer Health Data Privacy Law. Undefined capitalized terms shall have the meaning in the Privacy Policy.
Sources of Consumer Health Data
As described further in our Privacy Policy, we collect information, which may include consumer health data:
- Directly from you
- Automatically through your use of the Services
- From other third-party sources; and
- From publicly available sources.
Categories of Consumer Health Data We Collect
As described further in our Privacy Policy, and depending on how you interact with Excel Medical and applicable law, we may collect the following categories of consumer health data:
- Data that identifies you as a consumer seeking health care services.
- The following information in connection with medical histories you complete or when seeking healthcare services from a healthcare provider that provides services through the Services:
- Individual health conditions, treatment, diseases, or diagnoses.
- Social, psychological, behavioral, and medical interventions.
- Health-related surgeries or procedures.
- Bodily functions, vital signs, symptoms, or measurements of health information you provide when seeking healthcare services or medications from Excel Medical.
- Diagnoses or diagnostic testing, treatment, or medication: E.g. as part of the medical history collected by Excel Medical, or when you otherwise seek healthcare services or medications from Excel Medical.
- Gender-affirming care information.
- Reproductive or sexual health information.
- Use or purchase of prescribed medications.
- Other information that may be used to infer, derive, or extrapolate data related to the above or other health information.
How We Use Consumer Health Data
We describe the purposes for the collection and use of consumer health data in the “How We Use Personal Information” section of our Privacy Policy. As further described there and subject to applicable law, we may collect and use consumer health data as directed by you or with your consent, or:
- To provide and manage the Services;
- To analyze and improve the Services; and
- for legal purposes, such as to comply with laws or to establish, exercise, or defend our legal rights.
How We Disclose Consumer Health Data
As described in the “How We Disclose Personal Information” section of our Privacy Policy, and subject to applicable law (e.g. subject to your consent in certain situations), we may share consumer health data with the following categories of third parties and affiliates:
- Health care providers you interact with through the Services;
- Service Providers;
- Law enforcement, government agencies, and others for legal, security, or safety purposes;
- Other entities in connection with a corporate transaction;
- At your direction or with your consent; and
- With the following affiliates: AEMA Labs, Inc
How To Exercise your Rights
Subject to exceptions, you may have certain rights regarding your consumer health data. Depending on your jurisdiction, you may have the following rights:
- Right to Access. You have the right to confirm whether we process your consumer health data and to obtain information about how we process that data.
- Right to Delete. You have the right to request that we delete your Consumer Health Data.
- Right to Withdraw Consent. If you provided consent for our processing of your Consumer Health Data, you may have the right to withdraw that consent.
- Right to Change. You have the right to ask that we change the Consumer Health Data that we collect.
You can seek to exercise these rights by emailing us at dataprivacy@excelmedical.com. Depending on the nature of your request, we may contact you for further information if appropriate to authenticate your identity using this form.
Appeal: If we deny your rights request, you may have the right to appeal. To submit an appeal, contact us at dataprivacy@excelmedical.com. We will inform you of our response.

We may revise this Policy from time to time. Any revised Policy will be effective when posted. The date this Policy was last revised is identified at the top of the document. Please check this Policy periodically for updates.
